CT Legislative Update - Prior Authorization Reforms

The COS advocates for meaningful legislative change to benefit patients and the practice of orthopaedic surgery.

 

The 2023 session of the CT Legislature began January 4, 2023, and your Society is committed to advocating in support of bills that help orthopaedic surgeons, the practice of medicine and patients. 

 

The proactive, patient centered lobbying we are working toward this legislative session includes reforms to the High Deductible Health Plans and Prior Authorization practices of insurers, prohibiting drug formulary changes and seeking increased Medicaid reimbursement as well as reimbursement for devices and implants used in the care and treatment of Medicaid patients in Ambulatory Surgery Centers. We will continue to protect patient safety by responding to any scope of practice issues that go beyond a profession’s training and education.

 

The Senate Democratic Priorities Caucus just released their initiatives and the bill has several key components to protect patients and includes the following prior authorization reforms which should be beneficial to the orthopaedic community.


SB 6- An Act Concerning Prescription Drug Affordability and Protections For Connecticut's Health Care Consumers.

Prior Authorization Reforms Proposed:

a.      Require staffing on weekends by insurers of prior authorization staff.

b.      Require 24/7 staffing to respond to prior authorization.

c.       Require insurance to accept prior authorization requests electronically.

d.      Create a “gold card” for prior authorization so insurers cannot require prioritized authorization for frequently approved drugs or services.


We have a long way to go until June 7th (adjournment of legislature) and we need Connecticut's orthopaedic community to help deliver our positions to the Legislature. Throughout the session, we will be reaching out to the membership with grassroots alerts.

State Mandatory HIE Compliance-CONNIE - May 3, 2023

Several years ago, Connecticut mandated in statute (C.G.S.A § 17b-59e), that all licensed health care providers, including physicians, in the state connect to the state-designated HIE, Connie.


To meet the mandate, all health care providers need to complete the Commitment to Connect Form by May 3, 2023, to affirm your organization's good faith commitment to start the onboarding process. Please consider legal review of the CONNIE "Commitment" contract and additional documents. As per the Statute, for those without EMR capability to connect to CONNIE, the practice will need to be capable of sending and receiving secure messages as specified in the Statute.


The COS continues to have concerns with the implementation of CONNIE including, the financial costs to the practice and impact on physician's offices and health care consumers. We are working on a meeting with the Office of Healthcare Strategy to address the concerns however, it is important to note that at this time, the mandate for compliance by all healthcare providers is May 3, 2023.

Good Faith Estimate & Surprise Billing - What to Know

As a benefit for COS members, the Society’s General Legal Counsel, Garfunkel Wild, created a valuable alert for Connecticut’s orthopaedic community regarding the Good Faith Estimate (GFE) requirement of the federal, No Surprise Bill law.


The GFE requirement has been in effect since January 1, 2022, however the Department of Health and Human Services revised its guidance for a second time on December 2, 2022. 


Members should also familiarize themselves with their hospital's GFE policy.

Ronald A. Ripps, MD

May 1943 - November 2022

The Connecticut Orthopaedic Society (COS) and members of the Board mourn the passing of past president and longtime board member, Ronald Ripps, MD. Dr. Ripps served as COS President from 2001 to 2003, and is being remembered for his leadership, foresight, and contributions to the Society. He joined the Society’s Board in 1996, and for over a decade was a mentor to many, both professionally and within the Society.  

 

Under his leadership and tutelage as President of the Society, Dr. Ripps laid a solid foundation for growth and expansion of the professional society to represent orthopaedic surgeons on legal, regulatory, and professional fronts. He was a contributing editor to BACKBONE, the Society’s original newsletter, writing articles of human interest and professional importance. In 2008, Dr. Ripps was honored with the Society’s highest award, Orthopaedist of the Year, for his work in developing a thriving and relevant professional organization. 

 

He was the founder of Connecticut Family Orthopedics in Danbury, served on the Board of the Fairfield County Medical Association and the Connecticut State Medical Society’s Legislative Committee. Dr. Ripps served as Chief Flight Surgeon at Dyess Air Force during the Vietnam War. He received his medical degree from Tufts University Medical School.

 

He will be missed and fondly remembered. The COS Board extends their sympathy to Dr. Ripps’ wife, Barbara, and their family. 

 

In 2008, his son Noah wrote an article reflecting on his father’s career as an orthopaedic surgeon which was published in the Society’s, Backbone Newsletter in the Summer of 2008.

COS Membership Renewal


The COS is the only statewide association representing Connecticut’s orthopaedic community. In 2022, working on behalf of orthopaedic surgeons and their patients,

 

COS, as a coalition member, and its lobbyists successfully repealed the onerous ASC tax of seven years in Connecticut saving ASCs millions of tax dollars. Members lobbied and testified on this and other important issues impacting the profession in 2022.


COS representatives met in D.C. with CT House of Representatives and U.S. Senators to lobby for Prior Authorization Reform, and urged congress to avert the 2023 Medicare Payment Cuts.


We have much more work ahead in 2023,

  • Prior Authorization Policy Reforms
  •  Increase Medicaid reimbursements
  •  Ensuring scope expansion equates to patient safety and more.

The AAOS strongly supports the federal advocacy activities of the Connecticut Orthopaedic Society in Washington, D.C.  


There are two major and critical bills the AAOS PAC is working to secure passage by the Senate; Prior Authorization Reforms in Medicare and delaying the Medicare payment cuts scheduled to go into effect January 2023.   


To ensure the strength of Connecticut orthopaedic surgeons on a federal level, our Society continues to support the AAOS OrthoPAC with 100% statewide participation.
